It has been a common talk that the delay in deciding case is virtually denying justice. Basically it is a fact and it cannot be disputed also. One has to accept it gracefully and try that delay is not caused. I have been in the field for more than 42 years and I have experienced so many things and the experience has not come to a halt. There are several causes and reasons for the delay in justice delivery system. One has also to find out ways and means how to over come with the problem. It is not possible for me to write in one stroke and to display forth with on the site. I will try to write in piecemeal and will site accordingly. As esteemed readers, hope it will be viewed and suitable suggestions are given so that the matter may be fully discussed. One thing to request is does not jump on suggestions but stapes by stapes give suggestions so that the points are thrashed out. I know that the mind and heart of the readers is inflated with full of anger but the things are to be defused slowly and gradually.

Delay in justice delivery system
Let us see the dictionary meaning of the word Delay. If there is a delay, something does not happen until later than planned or expected. If you delay doing some thing you do not do it immediately or at the planned or expected time, but you live it until later. It is failure to do something immediately or in the required or usual manner. The old poor Shakespeare was, perhaps assaulted by delay and thereafter about 400 years ago in the year 1600-01 he wrote few lines as under.
For who bears the whips and scorns of time, /
The oppressor’s wrong, the proud man’s contumely, /
The pangs of dispraised love the laws delay, /
The insolence of office, and the spurns, /
That patient merit of the unworthy takes, /
When he himself might in his quietus make, /

Before entering in the field of justice and delay in delivering justice let see what is law?
Law may be defined as rules written or oral or unwritten by which a country or any institution or family or body of persons is governedand ,the activities of people or organisation controlled or regulated. Such law is passed by the legislative of a State, To be more simple law is the body of principles recognised and applied by the State in the administration of justice or more shortly the law consist of rules recognaised and acted on in the courts of justice.

Genesis and Species These two words are important to know the background relating to delay in justice delivery system. Genesis means generation, creation development or production. The plural is genera. Species [plural also] is a class of plants or animal whose members have the same characteristics. It is a set of things within one of these classes. Class of individuals having same common characteristics or qualities. Species includes classes of things includes with other classes in génues.With these words and their meaning we shall see laws of the land,teachers [the genesis] and the students[the species]

Transfer of Police officers
The news in the news papers if true, then few SPs deserve to be congratulated for disregarding the M.P.state Home Minister’s request to transfer some police personnel from one place to another. The Home Minister has every right to request the concerned officer for such adjustment but this does not mean that every request is to be treated as order and the officer should work in pressure. It is an administrative matter and the officer in-charge has his discretion. The only way for the Home Minister was to understand the constraint of the officer in-charge or he may him self could have officially directed the DGP to do so. One cannot play hide and sick game at the same time.

Police Commissionaires
It is just a fad that few metro cities like Indore and other should be converted in to police Commissionaires. There will be no change in the working of the police as the police and executive cannot change their nature of functioning as these departments have developed taste for arbitrariness and the politicians cannot control them as the politicians have vested interest with them. Though the departments may have desire to work fairly but the politicians would not allow them to do so. To establish Police Commissionaires is just to satisfy the false ego of the police that the police do not want to work under executive. The simple preposition is those who have power to order should not have power to execute the orders. If police is vested with certain powers under Code of Criminal Procedure it is sure to be misused as when police has no power in certain matters it generally transgress the same and violet the procedure. Look to the districts in other states where police commissionaires are established and one may experience that the whole system is not only failure but the police there has become more corrupt.

Trials under Preventive sections
Presently the power to try cases of preventive sections like 107 to 110 and sections 145-146 Cr.P.C. Lies with police and the cases could not be decided in reasonable time as the executive magistrates are always busy in other executive work and they do not and could not find time to do the criminal work. There are huge complaints about corruption to grant bail where as bail is to be granted in routine manner in such cases. There is need that the state government should amend the Code suitably to try such cases by regular judicial Magistrates so that corruption may be reduced and cases may be disposed of earlier. The number of judicial Magistrates has sufficiently increased by appointment of about 300 judges. Their services should be utilized.
